However, because it contains the controversial ABC test to determine who is an employee under the NLRA, the PRO Act threatens the careers of professional freelance writers. ASJA advocates for replacing the ABC test with another test or changing its language, as many freelance writers would be classified as employees under the NLRA under this bill.
The PRO Act was passed by the House of Representatives in March 2021. It is currently under consideration by the Senate Committee on Health, Education, Labor, and Pensions (HELP). The bill is heavily supported by Democrat Congressional members, and President Biden.
